Is a gorgonian a coral or an invert?
I see some website listing them under corals and some listing them under inverts.....so which do they fall under?

Cnidaria (corals and jellyfish or anything that stings) is a phylum within invertebrates, as TheORKINMan said.

its definitely an invertibrate, anything alive that doesnt have a spine is an invertibrate, unless its a plant... coral is not a scientific term AFAIK and you can consider whatever you want to be a coral.
kind of a semantics thing, why do you ask?

Reason I'm asking is that I'm in the process of researching setting up a local tank. One thing that it says they don't want you collecting is live rock or coral. I know we have other corals, like encrusting types in the area but I'm trying to find out if that includes gorgonians as well.

I would think it would include gorgonians, an octocoral.

Yeah they would consider it a coral.
