Borrowing Photos from Gallery

I put this in the Photography forum but I think I will get more replies here so I am putting this thread here too. Sorry for the double post if anyone read it over there already.

Is it normal and acceptable for online coral retail stores to take photos out of people's galleries and put them up on their site as photos of corals they have for sale?

Just wondering if it is something RC members think is acceptable. I imagine it is legal. You would think however that they would put credit on the photo at least. They are going to make a profit by using my photo.

Now that's funny. I don't think I will sue but the more I hear from other RC folks the more I want to at least contact them about it.

Any photograph that you take is yours. You own the copyrights to that photo. If someone is using the photo without your consent that is illegal. You have the right to ask them to stop using your photo. If they choose not to, you can sue for damages.

"While copyright law makes it technically illegal to reproduce almost any new creative work (other than under fair use) without permission, if the work is unregistered and has no real commercial value, it gets very little protection. The author in this case can sue for an injunction against the publication, actual damages from a violation, and possibly court costs."

like I said take them to court..

Aaahhh, I am not going to take them to court. Too many people sue for things that are insignificant. I will just make sure they know that they should have taken their own pic of the coral they wanted to sell and that everyone on RC now knows that they did it.

I had it happen they removed the image and gave me some gift certificates for their store, I have not used it yet. In the end I will have to spend money which sucks and is wrong but what is one to do
